Sex Related Offences
A person commits an offence if they intentionally arrange or facilitate something they intend to do or intend the other person to do or believe another person will do in any part of the world that results in the commission of any of the above offences. They do not commit an offence under the Article if they arrange or facilitate something they believe another person will do, but they do not intend to do it themselves, or intend another to do it, and the offence is for the purpose of protecting the child from sexually transmitted infections, protecting physical safety, protection from pregnancy, or emotional well-being by giving advice, and included provided they are not inferred to be obtaining sexual gratification or for the purpose of causing or encouraging the activity constituting the offence. The above offence is subject to summary conviction with a term of imprisonment up to six months, or upon indictment, up to 14 years.
A person over 18 commits an offence if they meet or communicate with another person on at least two occasions, and subsequently, intentionally meet them or travel with the intention of meeting them anywhere in the world, or arrange to meet them. This also applies if the other person travels with the intention of meeting the accused person. If the person intends to engage in any activity during the meeting, anywhere in the world, which would constitute an offence or a relevant offence, and the person is under 16, or the accused person does not reasonably believe them to be under 16.
The offences encompass any offence under the above order. A person guilty of an offence is subject, on summary conviction, to a sentence of up to six months and a statutory maximum fine, or, on indictment, to imprisonment for up to 10 years.
It is an offence to intentionally obtain sexual services for payment or promise of payment from a child under 13 or under 18 where the person does not reasonably believe the person is over 18. Payment includes any financial advantage or discharge of an obligation or the provision of goods. A person guilty of the offence against a person aged 16 or less may be convicted on indictment with imprisonment for up to life.
A person guilty of an offence against a person under 16 is liable to conviction on indictment for up to 14 years, or on summary conviction for up to six months and a fine not exceeding the statutory maximum, or on indictment for up to 14 years.
It is an offence to intentionally cause or incite another person to become a prostitute or to become involved in pornography anywhere in the world if the person concerned is under 18 and the person does not reasonably believe the person to be over 18 or the person is under 13. A person is liable on conviction to a summary offence for up to six months or a statutory maximum fine, or on indictment for up to 14 years.
It is an offence for a person to intentionally control the activities of another person relating to prostitution or involvement in pornography if that other person is under 18 and they do not reasonably believe the person to be over 18 or the person is under 13. The same potential punishment on summary conviction or indictment applies as set out above.
It is an offence for a person to intentionally arrange or facilitate prostitution or involvement in pornography on the part of another person in the above categories anywhere in the world. The same penalties apply.
A person who is involved in pornography, if an indecent image of that person is recorded. A prostitute means a person who, on at least one occasion, whether or not compelled to do so, offers or provides sexual services to another in return for payment or the promise of payment or another financial advantage.
